Sine Cura Cyber Terms of Service
Effective date: [EFFECTIVE DATE] Last updated: [EFFECTIVE DATE]
These Terms of Service (“Terms”) are an agreement between you and Sine Cura Cyber LLC, a Georgia limited liability company (“Sine Cura Cyber,” “we,” “us,” or “our”). They govern your use of the Sine Cura Cyber iOS app (the “App”), the Sine Cura Cyber Windows helper (the “Helper”), our website at sinecuracyber.com, and related services (together, the “Service”).
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Please note Section 13 (Dispute Resolution) [IF ARBITRATION IS ADOPTED, ATTORNEY TO CONFIRM], which affects how disputes are resolved.
1. What the Service is (and what it is not)
Sine Cura Cyber helps you keep an eye on the computers in your home. The Helper reads the status that the built-in Windows Security / Microsoft Defender already reports on a Windows PC (such as whether protection is on and whether threats were detected), and the App shows that information on your iPhone in plain English and can send you alerts.
Please understand the limits of the Service: - Sine Cura Cyber monitors and reports. It does not scan for, block, quarantine, or remove viruses or other threats. That protection is provided (or not) by Windows Security / Microsoft Defender and any other security software on the PC. - The Service depends on information reported by Windows, on the PC being turned on and connected to the internet, and on third-party services (such as Apple, Google Firebase, and Microsoft). Status may be delayed, incomplete, or inaccurate, and notifications may not always be delivered. - The Service does not guarantee that any computer is secure or free from malware, intrusion, data loss, or other harm. You remain responsible for the security of your devices, accounts, and data, including keeping software updated and backing up important files. - Plain-English explanations and suggestions in the App are general information, not professional IT or security advice.
2. Not affiliated with Microsoft
Sine Cura Cyber is an independent product. It is not affiliated with, endorsed by, sponsored by, or approved by Microsoft Corporation. Microsoft, Windows, Windows Security, and Microsoft Defender are trademarks of the Microsoft group of companies. Apple, iPhone, and Sign in with Apple are trademarks of Apple Inc. All other trademarks are the property of their respective owners and are used only to describe compatibility.
3. Eligibility and accounts
- You must be at least 18 years old (or the age of majority where you live) to create an account. The Service is designed for parents, guardians, and other adults who manage household computers.
- You may sign in with Apple or with an email address and password. You are responsible for keeping your login credentials secure and for all activity under your account. Tell us promptly at support@sinecuracyber.com if you suspect unauthorized use.
- Provide accurate information and keep it up to date.
4. Devices you connect
- Only install the Helper on computers you own or are authorized to manage (for example, PCs in your household that you are responsible for). You are responsible for having any permission needed from the owner or adult users of a PC before connecting it.
- If other people use a connected PC (including children), you are responsible for letting them know, as appropriate, that the PC’s security status is being reported to you. The Helper does not collect personal content such as files or browsing history (see our Privacy Policy).
- You can remove a PC from your account at any time in the App and uninstall the Helper from the PC.
5. Plans, pricing, and subscriptions
5.1 Free plan
You can monitor 1 PC for free. We may change free plan features in the future with notice.
5.2 Family plan (auto-renewing subscription)
The Family plan lets you monitor up to 10 PCs. It is offered as an auto-renewable subscription purchased through Apple’s App Store: - Sine Cura Cyber Family, Monthly: US$3.99 per month - Sine Cura Cyber Family, Yearly: US$34.99 per year
Prices are in U.S. dollars; prices in other countries are set by local App Store pricing and may include applicable taxes. [IF A FREE TRIAL IS OFFERED, ADD: “The Family plan may include a free trial of [X days]. Any unused portion of a free trial is forfeited when you purchase a subscription.”]
Subscription terms (required by Apple): - Payment will be charged to your Apple ID account at confirmation of purchase. - The subscription automatically renews for the same period and price unless it is canceled at least 24 hours before the end of the current period. - Your account will be charged for renewal within 24 hours prior to the end of the current period. - You can manage and cancel your subscription in your App Store account settings (on iPhone: Settings → [your name] → Subscriptions) after purchase. - Deleting the App or deleting your Sine Cura Cyber account does not cancel your subscription. - If you cancel, you keep Family plan access until the end of the period you already paid for. Afterward, your account returns to the free plan; you will need to choose which 1 PC remains active [CONFIRM BEHAVIOR].
5.3 Refunds
All purchases are processed by Apple. Refund requests are handled by Apple under its policies; you can request one at https://reportaproblem.apple.com. We cannot issue refunds directly for App Store purchases. [CONFIRM REFUND POLICY.]
5.4 Price changes
We may change subscription prices. Apple will notify you of price changes as required by its rules, and where required, you will be asked to consent before a price increase takes effect.
6. License to use the App and Helper
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App and Helper for your personal, non-commercial household use.
Apple’s Standard EULA. If you downloaded the App from Apple’s App Store, your use of the App is also governed by Apple’s Licensed Application End User License Agreement (“Standard EULA”), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. If these Terms conflict with the Standard EULA regarding the App, the Standard EULA controls to the extent required by Apple; otherwise these Terms supplement it. You acknowledge that these Terms are between you and Sine Cura Cyber LLC only, not Apple; that Apple is not responsible for the App or its content, maintenance, support, warranty, or any related claims; and that Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as they relate to the App.
7. Acceptable use
You agree not to: - install the Helper on any computer you are not authorized to manage, or use the Service to monitor anyone unlawfully; - reverse engineer, decompile, or modify the App or Helper, except where the law expressly allows it; - interfere with, overload, probe, or attempt to gain unauthorized access to the Service, other accounts, or our systems; - send false or tampered data to the Service, or circumvent plan limits; - resell, rent, or use the Service for commercial managed-service purposes without our written permission; or - use the Service in violation of any law.
8. Your data
You keep ownership of the information you provide. You give us permission to process it only to provide and improve the Service as described in our Privacy Policy. You can delete your account and data at any time in the App.
9. Feedback
If you send us ideas or suggestions, we may use them without obligation to you.
10. Changes, suspension, and termination
- We may update, change, or discontinue features of the Service. If we discontinue the Service entirely, we will give reasonable notice where practical.
- You may stop using the Service and delete your account at any time.
- We may suspend or terminate your access if you materially violate these Terms, if required by law, or to protect the Service or other users. Where appropriate, we will tell you why.
- Sections that by their nature should survive termination (including Sections 2, 8, 11, 12, 13, and 14) will survive.
11. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, ERROR-FREE, OR ACCURATE; THAT ALERTS WILL BE DELIVERED; OR THAT ANY COMPUTER WILL BE PROTECTED FROM MALWARE, ATTACKS, OR DATA LOSS. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, Sine Cura Cyber LLC AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, OR DAMAGES ARISING FROM MALWARE, SECURITY INCIDENTS, OR MISSED OR DELAYED ALERTS, ARISING OUT OF OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US$50.
Some jurisdictions do not allow these limitations, so they may not fully apply to you. Nothing in these Terms limits liability that cannot be limited by law, or your rights as a consumer under mandatory local law.
13. Governing law and disputes
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. Except where prohibited by law, any dispute will be resolved exclusively in the state or federal courts located in [COUNTY], Georgia, and you and we consent to their jurisdiction. Either party may bring an eligible claim in small claims court. [ATTORNEY TO DECIDE WHETHER TO ADD AN ARBITRATION AGREEMENT AND CLASS-ACTION WAIVER.] Before filing any claim, please contact us at support@sinecuracyber.com so we can try to resolve it informally.
14. General
- Entire agreement. These Terms, our Privacy Policy, and (for the App) Apple’s Standard EULA are the entire agreement between you and us about the Service.
- Changes to these Terms. We may update these Terms. If changes are material, we will notify you in the App or by email before they take effect. Continued use after the effective date means you accept the updated Terms.
- Severability. If any part of these Terms is unenforceable, the rest remains in effect.
- No waiver. Our failure to enforce a provision is not a waiver.
- Assignment. You may not transfer these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- Export. You represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties.
